Vaccine injury claims are not handled in the same manner as other claims for bodily injury.  Instead, vaccine injury claims are handled through the federally funded National Vaccine Injury Compensation Program, and only attorneys admitted to practice before the Vaccine Court are qualified to handle those claims.  The National Vaccine Injury Compensation Program provides monetary awards to parties injured by one or more vaccinations who meet certain requirements, and also pays the attorneys’ fees incurred by the injured party pursuing a claim in the Vaccine Court.

The types of vaccines that are included under the National Vaccine Injury Compensation Program include, but are not limited to, the following:

  • flu/seasonal influenza shot
  • tetanus shots
  • Hepatitis vaccines
  • HPV vaccines
  • meningitis vaccines
  • vaccines for measles, mumps and rubella
  • rotavirus vaccines
  • chickenpox (varicella) vaccines
  • polio vaccines

The types of compensable injuries, illnesses, conditions and diseases that can result from vaccinations include shoulder injuries, encephalitis, anaphylaxis (also known as allergic reaction), Guillain-Barr Syndrome, Chronic Inflammatory Demyelinating Polyneuropathy (CIDP), Intussusception, Parsonage-Turner Syndrome, Acute Disseminated Encephalomyelitis, and death, among other conditions.
